For those who wish to obtain an adoption attorney to guide them throughout the process, there are a few key factors to keep in mind when it comes to choosing the right type of adoption attorney.

What to Look For in an Adoption Attorney

Parents who retain an adoption attorney should consider a few different things when selecting the person who will represent their interests throughout the adoption.

The first thing to consider is the true knowledge of the attorney when it comes to adoption matters. Some attorneys will specialize in a wide array of legal fields, ranging anywhere from criminal law to real property law. Although there is nothing wrong with an attorney who specializes in various fields, it may be in your best interest to choose an adoption attorney who practices only adoption law/family law. Since adoption is a very specialized type of law, choosing an attorney who practices only this type might be your best option.

Another thing to look for in an adoption attorney is availability. Attorneys are busy professionals who keep their days quite filled. Since adoption issues can arise at any time of the day, on any particular day, it is important to know that the attorney who is chosen to represent the adoptive parents will be able to make himself/herself available to the parents on an on-call basis. Try to find out if the attorney can be reached evenings and weekends.

Questions to Ask the Prospective Adoption Attorney

When hopeful adoptive parents go searching for an adoption attorney to help them with the adoption, it is important to have a list of questions on hand in which to ask the attorney prior to retaining them. The first thing to ask the attorney relates to their fees. The fees charged will vary from attorney to attorney as will the fee structure. Therefore, one needs to ask how much the attorney charges and in what form does the attorney charge the fees, such as hourly fees or flat fees.

It is also a good idea to ask the attorney what will happen with regard to fees if the adoption does not go through. Since adoptions can fall through from time to time, it is important to ask the attorney what fees will still be charged for the legal assistance. This too will depend on the particular attorney who represents your interests.

It is also good to ask about the estimated time it may take to complete the adoption process. Although this will vary from case to case, a seasoned veteran of adoption law should be able to give an estimate based on his/her past experience with particular types of adoptions.
